1. Scope and acceptance
These Pre-order Terms apply only to a direct pre-order placed with 8ight through an authorized checkout flow. The final checkout will identify the contracting seller, the selected package, the total price, applicable taxes and charges, payment timing, delivery estimate, and when the order becomes binding.
Submitting a pre-order request does not guarantee acceptance or inventory allocation. 8ight may reject an order before acceptance for legitimate reasons such as payment failure, suspected fraud, legal restrictions, unsupported destinations, obvious pricing errors, or unavailable allocation. Any collected amount for a rejected order will be refunded.
2. Waitlist and Kickstarter pledges
Joining the waitlist does not create an order, reserve inventory, guarantee campaign access, or require payment. It is used for product and launch communications.
A Kickstarter pledge is not a direct Shopify pre-order. Kickstarter platform rules, the official campaign page, reward descriptions, estimated delivery dates, and creator obligations apply to pledges. These Pre-order Terms do not replace those campaign-specific terms.
3. Eligibility, availability, and order limits
Pre-orders may be limited by age, destination, certification, inventory allocation, campaign phase, or quantity. Available regions and order limits will be shown before payment. 8ight may use reasonable measures to prevent duplicate, fraudulent, reseller, or otherwise abusive orders, while respecting applicable consumer law.
4. Product and package information
The product page and checkout will identify the package being reserved, including the version of 8ight Pro, included accessories, available lens option, and any software or account requirements known at that time. Prescription and photochromatic lens availability, compatibility, and any separate fulfillment steps will be explained before purchase where applicable.
Images, prototypes, and pre-production materials may differ from the final product. 8ight may make reasonable changes required for safety, compliance, reliability, manufacturing, or performance. A material change that substantially reduces the core product or package will be communicated, and affected customers will be offered any cancellation or refund rights required by law.
5. Price, taxes, shipping charges, and payment
The checkout will show the total price then known, the currency, shipping charges, taxes collected by 8ight, and any additional costs that can be calculated in advance. Potential duties, import taxes, brokerage fees, or recipient charges will be disclosed when they cannot be included in the checkout total.
The checkout will state whether payment is collected in full, collected as a deposit, authorized for later capture, or scheduled in installments. No optional charge will be added through a preselected choice. Customers will receive an order confirmation in a durable format such as email.
6. Customer cancellation and withdrawal rights
The cancellation method and any voluntary cancellation window will be shown before payment. Customers can contact support using the order email and reference number. Refunds will be returned to the original payment method unless another method is required by law or agreed with the customer.
Nothing in these terms limits mandatory rights. Where applicable, EU consumers generally have a 14-day right of withdrawal for online purchases beginning on delivery of goods, subject to legal exceptions and the information provided before purchase.
7. Changes or cancellation by 8ight
8ight may cancel a pre-order before fulfillment if the product cannot lawfully or reasonably be supplied, the destination is unsupported, payment cannot be processed, or the launch is discontinued. If 8ight cancels an accepted paid pre-order, the customer will receive a full refund of the amount collected for that order.
8ight will not use these terms to impose a material unilateral price increase or substantially different product without giving affected consumers a meaningful cancellation and refund option where required by law.
8. Estimated delivery and delays
Production, shipment, and delivery dates are estimates unless expressly identified as guaranteed. 8ight will only publish a shipment estimate when it has a reasonable basis. Testing, certification, manufacturing, component availability, battery transport, customs, and carrier conditions can affect timing.
If 8ight cannot ship within the promised or legally required period, customers will receive a delay notice and revised estimate when reasonably available. Where required by applicable law, customers will be offered the choice to accept the delay or cancel for a full and prompt refund. U.S. orders covered by the FTC Mail, Internet, or Telephone Order Merchandise Rule will receive the applicable delay, consent, cancellation, and refund options.
9. Shipping, duties, and address changes
The Shipping Policy forms part of these terms. Customers are responsible for providing complete and accurate delivery information. Address changes may be restricted after fulfillment preparation begins. Available destinations, shipping costs, duty treatment, and battery-related carrier restrictions will be disclosed before checkout or shipment as applicable.
10. Returns, warranty, and statutory remedies
Returns, repairs, warranty coverage, and support will follow the policies provided before fulfillment. These policies do not exclude mandatory legal guarantees or remedies for goods that are defective, damaged, unsafe, misdescribed, or not supplied as agreed.
11. Privacy, account, and responsible use
Personal information used for a pre-order will be handled according to the Privacy Policy. Customers are responsible for securing their account and providing accurate contact information. Use of 8ight Pro must follow applicable law, venue rules, consent expectations, and the Responsible Use guidance.
12. Mandatory rights and final terms
If any provision conflicts with non-waivable consumer law, the mandatory law controls and the remaining provisions continue to apply where permitted. The version presented at checkout, together with the order confirmation and incorporated policies, will govern the direct pre-order.
